Only the premium portion (the 0.5x part of time-and-a-half) qualifies — not your full overtime pay. If you earn $20/hr and work 10 overtime hours, only $100 (10 × $10) qualifies, not $300.
Qualifying tips are amounts voluntarily given by customers in a tipped occupation — not mandatory service charges. Earn more than $5,000/year in tips? Do not leave Step 4(a) on your 2026 W-4 blank.
California, Alabama, Colorado (OT only), DC, and New Mexico have decoupled from the federal OBBBA overtime exclusion. Your state income tax still applies to 100% of overtime in those states.
Social Security is 6.2% on wages up to $184,500. Medicare is 1.45% with no wage cap. Workers earning above $200,000 (single) also owe the 0.9% Additional Medicare Tax. Both employee and employer pay the same rate.
The One Big Beautiful Bill Act provides a federal above-the-line deduction of up to $12,500 for qualifying overtime premium pay and up to $25,000 for qualifying tips. It is a tax return deduction — your employer still withholds FICA and federal income tax on those earnings unless you adjust your W-4.
California, Alabama, DC, and New Mexico have fully decoupled. Colorado partially decoupled (taxes OT but exempts tips). New York is coupled with a 2026 cost-of-living auto-adjustment. All other states generally follow federal treatment.
Biweekly take-home = (Annual Gross ÷ 26) minus federal income tax withheld per period minus Social Security (6.2%) minus Medicare (1.45%) minus state income tax. Use our biweekly calculator for a full per-paycheck breakdown.
$15,750 for single filers; $31,500 married filing jointly — a $500 increase from 2025. Taxpayers 65+ receive an additional $1,600. OBBBA also added above-the-line deductions for qualifying overtime and tip income.
